Terms of Service

1. Definitions

• 'Zetesia', 'we', 'us', or 'our' refers to the owners and operators of the Zetesia Platform.
• 'User' refers to any individual or entity that accesses or uses the Platform.
• 'Seller' refers to a User who lists goods or services on Zetesia.
• 'Buyer' refers to a User who browses, contacts, or transacts with Sellers.
• 'Content' includes listings, descriptions, images, reviews, messages, and any other material uploaded or displayed on the Platform.

2. About Zetesia

Zetesia is a discovery-driven virtual marketplace that enables Users to find, explore, and connect with businesses offering goods and services across multiple industries.

Zetesia provides tools that allow businesses to list, promote, and manage products and services while enabling users to discover and engage with those offerings. Zetesia:

• Does not own, manufacture, or supply listed goods or services
• Does not act as a broker, agent, or guarantor of transactions
• Does not control pricing, fulfillment, or service delivery
• Does not manufacture, store, inspect, or directly deliver goods

Any transaction or engagement occurs directly between Buyers and Sellers. However, Zetesia may provide dispute assistance or moderation when necessary, especially in dealing with cases of fraud.

3. User Accounts

Users may register as buyers, sellers, or both.

You agree to:

• Maintain the confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify Zetesia immediately of unauthorized access or suspected breaches

Zetesia is not liable for losses resulting from compromised accounts caused by user negligence.

4. Seller Responsibilities

Sellers using Zetesia agree to:

• Provide accurate product or service descriptions
• Ensure pricing, availability, and specifications are truthful
• Comply with applicable consumer protection, licensing, and regulatory laws
• Deliver products or services as advertised
• Respond to customer inquiries and disputes professionally
• Only transact with buyers through the payment accounts verified by Zetesia and provided on the stores' profile page to help Zetesia handle fraud cases. If a buyer provides proof of payment through a verified store payment account but the seller fails to provide reasonable proof of product delivery, Zetesia will help the buyer in advancing the case to the relevant legal authorities.

Zetesia reserves the right to, and will remove listings that are misleading, fraudulent, illegal, harmful, or violate platform policies.

5. Buyer Responsibilities

Buyers agree to:

• Provide accurate information when making purchases or inquiries
• Respect seller terms and transaction agreements
• Use the platform for lawful and legitimate purposes
• Avoid fraudulent, abusive, or harmful conduct
• Only transact with businesses through the payment accounts verified by Zetesia and provided on the stores' profile page to help Zetesia handle fraud cases. If a buyer provides proof of payment through a verified store payment account but the seller fails to provide proof of product delivery, Zetesia may provide reasonable cooperation with law enforcement or dispute investigations and will suspend the store from the platform if the fraud is proved.

Users may submit reviews and ratings based on genuine experiences. Reviews must:

• Be honest and factual
• Avoid harassment, defamation, or false accusations
• Comply with community standards

Zetesia may remove reviews that violate these Terms.

6. Content and Listings

Users retain ownership of Content they submit but grant Zetesia a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute such Content for Platform operation, promotion, and improvement.

You may not post Content that:

• Is false, misleading, or fraudulent
• Infringes intellectual property rights
• Is illegal, harmful, or abusive

Zetesia may remove Content at its discretion.

7. Fees and Payments

Zetesia may offer free and paid services, including subscription packages, promotional services, or seller tools. Zetesia does not charge transaction-based sales commissions.

All applicable fees will be clearly communicated before purchase. Fees are generally non-refundable unless stated otherwise.

Zetesia reserves the right to modify pricing with reasonable notice.

8. Limitation of Liability

To the fullest extent permitted by law:

• Zetesia is not liable for losses resulting from transactions between users, loss of profits, data, or business opportunities or indirect, incidental, or consequential damages
• Zetesia does not guarantee uninterrupted or error-free service
• Zetesia is not responsible for third-party content or actions

9. Intellectual Property

All Zetesia trademarks, logos, content, and technology remain the property of Zetesia or its licensors. Users may not copy, distribute, or exploit platform content without permission.

10. Account Suspension and Termination

Zetesia reserves the right to suspend, restrict, or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or harmful behavior
• Threaten platform integrity or user safety
• Upload malware or attempt to compromise platform security
• Harvest user data without authorization
• Circumvent platform protections or payment systems

11. Privacy

Use of Zetesia is also governed by the Zetesia Privacy Policy, which explains how personal data is collected, used, and protected.

12. Modifications to Terms

Zetesia may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict-of-law principles.
